Appel à pétition auprès des autorités djiboutiennes

La Ligue Djiboutienne des Droits Humains (LDDH) adhère pleinement aux soucis et aux préoccupations de tous les Défenseurs des Droits de l’Homme, sur la situation qui prévaut en Ethiopie.

Elle s’associe, en tant que pays concerné, à toutes les recommandations et Appels d’Amnesty International en particulier sur les points suivants transmis en anglais le 15 Juillet 2005 :

Two Ethiopian air force helicopter pilots, Captain Behailu Gebre and Abiyot Mangudai, flew a military helicopter to the neighbouring state of Djibouti on 9 or 10 June. They reportedly sought asylum and were reportedly held incommunicado detention without being charged. The Djibouti authorities have reportedly returned the helicopter and an engineer who was on board to Ethiopia.

Amnesty International is deeply concerned at reports that the pilots may have been forcibly returned to Ethiopia some days ago, where they would be at risk of being held incommunicado detention without charge or trial, tortured, or extra judicially executed.

The pilots reportedly claimed asylum on the grounds that they would be at risk if forcibly returned to Ethiopia, as they had not used the helicopter to attack opposition demonstrations who were protesting at alleged electoral fraud during Ethiopia’s elections on 15 May. It is not known if they had in fact been ordered to target demonstrators, as helicopters were not used by the Ethiopian security forces when they shot dead 36 protesters in the capital Addis Ababa on 8 June.

On 15 July, the Office of the United Nations High Commissioner for Refugees (UNHCR) expressed “deep preoccupation” over the fate of the two asylum seekers. It said the Djibouti Government has not replied to its repeated requests for access to the two men and for information on what has happened to them. If they are forcibly returned to Ethiopia, the Djibouti Government would be violating its obligations as a party to the UN Convention Relating to the Status of Refugees and the Organization of African Unity (OAU) Convention Governing the Specific Aspects of Refugee Problems in Africa.

La Ligue Djiboutienne des Droits Humains (LDDH) lance un Appel pressant au Chef de l’Etat de la République de Djibouti Son Excellence Ismaël Omar de bien vouloir, accorder toutes les facilités pour déterminer :
1. le sort réservé aux Capitaine Behailu Gebre et Abiyot Mangudai ;
2. les causes réelles de ces violations du Droit International ;
3. les raisons profondes du refus des Autorités Djiboutiennes d’accorder au Haut Commissariat des Nations Unis de rendre visite aux deux demandeurs d’Asile M. Behailu Gebre et Abiyot Mangudai

La Ligue Djiboutienne des Droits Humains (LDDH) demande :
1. à la Communauté djiboutienne, à la Communauté éthiopienne (pays voisin et frère), à la Communauté Internationale de se mobiliser, pour sauver la vie de ces deux victimes, pour les sauver d’une déportation.
2. aux Forces vives de la Nation djiboutienne de témoigner leur solidarité au deux pilotes , qui ont eu le courage de refuser de bombarder les Etudiants et les Opposants, lors des manifestations à Addis Abeba et leurs demande de saisir par des écrits, les personnalités politiques Djiboutiennes suivantes :

1. expressing deep concern about reports that two Ethiopian air force helicopter pilots, Captain Behailu Gebre and Abiyot Mangudai, may have been forcibly returned to Ethiopia after being detained incommunicado in Djibouti without charge or access to the UNHCR;
2. stating Amnesty International’s concern that they would be at risk of incommunicado detention without charge or trial, torture or extrajudicial execution if returned to Ethiopia;
3. calling on the Government of Djibouti to clarify their whereabouts, legal status and treatment if they are still detained in Djibouti, and for the UNHCR to be allowed immediate access to them;
4. reminding the Government of Djibouti of its obligation to ensure protection from forcible return (refoulement) of any person claiming asylum in its territory until a final decision on their application has been made in accordance with the Convention Relating to the Status of Refugees.

1. Exprimant une profonde inquiétude sur des rapports concernant deux pilotes d’hélicoptères des Forces de l’Armée de l’Air Ethiopienne, capitaine Behailu Gebre and Abiyot Mangudai, qui ont été refoulés de force vers Ethiopie après avoir été détenus en secret à Djibouti sans inculpation ni accès aux services du Haut Commissariat des Nations Unis pour les Réfugiés (UNHCR) basé à Djibouti ;
2. Amnesty International exprime son inquiétude face aux risques qui pourraient surgir pour les victimes en détentions secrètes, sans inculpation, ni procès, soumis à l’arbitraire, aux tortures voir même à des exécutions sommaires s’ils sont renvoyés en Ethiopie.
3. Demande au Gouvernement de Djibouti de clarifier : où ils sont, leur statut légal et leur traitement s’ils sont encore emprisonnés à Djibouti, alors permettre au UNHCR de les rencontrer immédiatement.
4. Rappelant au Gouvernement de la République de Djibouti toutes ses obligations pour assurer que ne s’effectue aucun refoulement des personnes demandant l’asile sur son Territoire jusqu’à ce qu’une Décision finale les concernant ait été prise en accord avec la Convention du Statut des Réfugiés.
